1. Who We Are

MyChat ("we", "us", the "Service") is a SaaS chatbot platform operated from Tallinn, Estonia. By creating an account or using the chatbot widget, you accept these Terms of Service and our Privacy Policy.

2. The Service

MyChat lets website owners install an AI chat widget that learns from their site content, answers visitor questions, and captures leads. We provide hosting, the AI backend, the embed script, the dashboard, and customer support.

3. Accounts

  • You must be at least 18 years old to register.
  • You are responsible for keeping your password confidential.
  • You are responsible for all activity under your account.
  • Notify us at info@mychat.ee of any unauthorised use.

4. Subscription & Billing

  • Free trial: Each new account gets one free 24-hour trial on its first bot, limited to 200 messages, no credit card required.
  • Paid plan: €19 per month per bot, billed in advance through Stripe.
  • Auto-renewal: Subscriptions renew automatically each month until cancelled.
  • Cancellation: You can cancel at any time from the Stripe Billing Portal accessible from your dashboard. Your bot continues to work until the end of the current paid period.
  • Taxes: Prices are shown excluding VAT where applicable; Stripe collects local VAT automatically.
  • Failed payments: If a renewal payment fails, the bot stops responding to visitors until payment is restored.

5. Refund Policy

Because the Service is provided on a month-to-month basis with a free 24-hour trial that covers the full feature set, we do not offer refunds for the current billing periodafter a successful charge. Cancellation stops future renewals.

In exceptional cases (duplicate charge, technical inability to deliver the service on our side, or charge made on a clearly compromised account), contact info@mychat.eeand we will review the request individually. Pro-rata refunds for unused time may be issued at our sole discretion within 14 days of the charge.

6. Acceptable Use

You may not use the Service to:

  • Send spam, unsolicited messages, or phishing content.
  • Host illegal, infringing, hateful, or harmful content.
  • Index websites you do not own or have permission to index.
  • Attempt to reverse-engineer, scrape, or overload the platform.
  • Resell the Service without a written agreement.

We may suspend or terminate accounts that violate these rules without refund.

7. Your Content

You retain ownership of all content you submit to the Service, including the website content indexed by the chatbot. You grant us a non-exclusive licence to store, process, and display this content solely to operate the Service for you.

8. Service Availability

We aim for high availability but do not guarantee uninterrupted service. Maintenance windows, third-party outages (Stripe, xAI, OpenAI), and force majeure events may cause downtime. No SLA is offered on the standard plan.

9. Limitation of Liability

To the maximum extent permitted by law, MyChat's total liability for any claim arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost revenue or lost data.

10. AI Output Disclaimer

The chatbot generates responses using third-party AI models. Output may be inaccurate, incomplete, or biased. You are responsible for reviewing your chatbot's configuration and informing visitors that they are interacting with AI. MyChat does not guarantee the accuracy of any chatbot reply.

11. Termination

You may delete your account at any time from the dashboard. We may terminate your account if you violate these Terms, fail to pay, or use the Service in a way that harms us or other users. On termination, your data is deleted within 30 days, except where retention is required by law (e.g. tax records).

12. Changes

We may update these Terms. Material changes will be announced by email to registered users at least 14 days before they take effect. Continued use of the Service after that constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the Republic of Estonia. Disputes that cannot be resolved amicably shall be submitted to the Harju County Court in Tallinn, unless EU consumer protection rules require otherwise.
